1. The pool is open from dawn to dusk.
2. No smoking in the clubhouse, pool or on the pool deck.
3. Children 12 and under are not permitted to swim under any circumstances
without a parent or other obligated adult present.
4. Children 13 and older are allowed to bring a guest to the pool. Proper
behavior is to be exercised.
5. No solo swimming.
6. Admittance only to residents in good standing and their accompanied guests.
7. All members are required to familiarize their children with all pool rules.
Parents are responsible for their children, whether that parent is at the pool or
not.
8. For safety reasons there can be no running, pushing, jumping in on others,
dunking or holding others under the water.
9. No children will be allowed to loiter in or around the bathhouse area.
Bathhouse is open during swimming hours.
10. Any food items taken to the pool or immediate area around the pool are the
responsibility of the homeowner. No eating in the swimming pool.
11. No glass, bottles, chinaware nor items in breakable containers are allowed in
the pool/picnic area. Gum is not permitted in the pool or pool area.
12. All trash must be placed in the receptacles provided. Each resident is
responsible for cleaning up after themselves and closing the umbrellas.
13. No alcoholic beverages are allowed for anyone under the age of twenty-one
(21). Consumption of alcoholic beverages is a matter of personal preference.
Containers of alcoholic beverages should be kept concealed. A person
showing signs of intoxication will be denied use of the facilities and is subject
to suspension and/or expulsion.
14. The Board of Directors has the authority to disallow exuberant play that may
interfere with the enjoyment of the pool by others.
15. The Board of Directors shall have the authority when they deem necessary to
expel anyone at any time for misbehavior, use of abusive language or apparent
intoxication. Those individuals may not return to the pool area until the
following day (To file a written complaint, write John Wieland Homes,
Joshua Miller, 8325D Arrowridge Blvd. Charlotte, NC 28273).
16. Water wings, children's small round floats, snorkel tubes, face masks, and soft
plastic balls under 12º diameter are permitted.
17. No pets, bicycles, skateboards or other vehicles are allowed in the pool area.
18. No one will be allowed to swim with open or infected wounds.
19. Babies in diapers must also wear rubber pants or swim diapers.
20. Cut-off's and other improper swim wear are not allowed in the pool.
21. The number of guests allowed at any given time will be limited to 8 per
family.
22. The health and safety of members and their guests is ultimately their own
responsibility. Anyone using the pool or clubhouse facilities has no claim
against the Neighborhood Association for any accident or injury. The
Neighborhood Association is not responsible for the loss or damage of
personal property.
23. The ratio of children to parent or other obligated adult will not be greater than
five to one.
24. The last person to leave must lock the gate and turn off the lights.
25. The pool cannot be reserved for exclusive use.
26. If you are renting the Clubhouse, you may not use the swimming pool.

GLENKIRK POOL USE AGREEMENT
In consideration for John Wieland Homes and Neighborhoods, Inc. and Glenkirk Neighborhood Association the non-exclusive use of the pool and related recreational facilities located in Glenkirk subdivision (hereinafter 'Pool') during the _____ swimming season. I, the undersigned, agree as follows:
1. I understand that children are not allowed to use the Pool without an adult in attendance and that solo bathing is prohibited.
2. I assume all responsibility, risks, liabilities and hazards incident to my use of the Pool and hereby release and forever discharge John Wieland Homes and Neighborhoods, Inc. and Glenkirk Neighborhood Association ('Association') and their officers, directors and employees, agents and members, past, present and future, from any and all claims, costs, causes of action and liability for personal injury or death and damage to or destruction of property arising from my use of the Pool.
3. I agree to indemnify and hold harmless John Wieland Homes and Neighborhoods, Inc. and the Association and their officers, directors and employees, agents and members, past, present and future, from any and all claims, costs, causes of action and liability (including but not limited to attorney's fees) resulting from negligence or otherwise for an injury, to any person or property, suffered by me, my family members, employees, agents, guests, invitees or any member of the Association or any other person which arise from or are in any way related to my use of the Pool.
4. I assume all responsibility for the actions and behavior of all persons present at the Pool at my request or invitation or as a result of this Agreement and agree to be personally responsible for causing all such persons to comply with the rules and regulations concerning Pool use.
5. I have carefully read and understand the Pool Rules and Regulations.
6. I have carefully read and understand this Agreement and agree to be bound by its terms.
